A: DEFINITIONS OF TERMS

Baggage: Client’s personal belongings packed for travel
Booking: Provisional order request by the client for tour or travel services
Cancellation fee: A fee deducted from the total program to cover any advance expenses incurred by Tanzania Elsewhere Safaris
Cancellation policy: A document that contains procedures and conditions that the client and/or service provider must observe when terminating a booking
Consequential damages: liability: Damage caused in the course of providing or using Tanzania Elsewhere Safaris services
Departure: A date when a client returns home. Also refers to the date when a client starts the safari/tour program
Deposit: An advance cash paid to the bank account for the booked safari program

Privacy policy: A document that discloses some or all of the ways Tanzania Elsewhere Safaris gathers, uses, discloses, and manages a customer or client’s sensitive data
Refunds: Cash paid back to the client after all refund policy procedures have been met
Reservation: To provide the client an initial place in the booking, subject to final confirmation & booking requirements
Travel documents: All necessary documents needed for travel, including VISA, passport, insurance documents, vaccination certificate, etc. These documents differ and depend on the client’s country of residence
Trip: A complete tour program/booking
Unforeseen circumstances: Circumstances that occur unexpectedly and outside of the control of Tanzania Elsewhere Safaris

B. ABOUT THE BOOKING TERMS AND CONDITIONS
These Booking Terms and Conditions apply to bookings from a direct-end client or agent who is booking on behalf of the client.
Bookings and subsequent contracts shall be deemed to have been concluded in Kilimanjaro, Tanzania and shall be interpreted according to the laws of the United Republic of Tanzania.
Tanzania Elsewhere Safaris reserves the right to change the price and associated booking terms and conditions and cancellation fee at any time without any prior consent of the clients. This includes changes due to government tax increases, unforeseen events or third-party service fees that affect the booked trip price.
C. TERMS AND BOOKING CONDITIONS
Tanzania Elsewhere Safaris accepts bookings subject to the following Terms and Conditions. By making a booking, clients and agents agree to be bound by these terms.
The Company reserves the right to refuse any booking that violates these Terms and Conditions, with or without providing a reason for the refusal.

D. DEPOSITS AND PAYMENTS
• A 30% deposit of the total trip cost is required to confirm and secure a booking. This deposit is considered part of the total payment for the tour.
• The remaining balance must be paid at least 30 days prior to the departure date. Failure to make full payment within this period may result in cancellation of the booking, and the deposit will be forfeited.
• For bookings made within 30 days of departure, full payment is required immediately to confirm the reservation.
• For bookings made on a payment installment plan negotiated with Tanzania Elsewhere Adventures, the client must adhere to the Payment Installment Plan Agreement
• All bank charges and transaction fees are the responsibility of the client or agent. This includes any fees charged by both sending and receiving banks.
• The full amount stated on the invoice must be received by Tanzania Elsewhere Safaris and Safari Limited net of any bank charges. The amount received should exactly match the invoiced price of the trip.

E. BOOKING AMENDMENTS
Amendments to existing bookings—such as changes in departure dates, air tickets, accommodations, number of participants, or similar—requested by the client or agent will incur a handling fee of USD 50 per booking.
This fee is charged in addition to any costs imposed by third-party service providers (e.g., airlines, hotels). The client or agent will be responsible for all additional charges arising from the requested changes, excluding the handling fee.

F. BOOKING PROCEDURE
1. Booking Submission
Bookings must be submitted through our online form available on our website: https://tanzaniaelsewhere.com.
By submitting this form, the client agrees to Tanzania Elsewhere Safari’s Booking Terms and Conditions and Privacy Policy.
2. Authority to Book
The person submitting the booking form does so on behalf of themselves and any other participants included in the booking. They confirm they have the authority to enter into a contract on behalf of those individuals.
Should any of the listed individuals fail to make payment, the person submitting the form assumes full financial responsibility for the total cost of all services booked.
3. Program Confirmation Upon receiving the completed booking form and after confirming program details, Tanzania Elsewhere Safaris will provide:
o Program schedule and booking details
o Associated program costs
4. Initial Deposit and Contract
Once both parties agree on the program details and budget:
o A formal contract and full invoice will be issued
o A 30% deposit of the total program cost must be paid to confirm the reservation
5. Booking Confirmation
After receiving the deposit, Tanzania Elsewhere Safaris will:
o Confirm your reservation
o Issue a confirmation letter
o Send detailed safari information, including packing lists, trip preparation guidance, medical guidance, orientation meetings, etc.prior to departure.
6. Final Payment
The remaining balance must be paid no later than 30 days prior to the scheduled trip start date. Late applicants may join only if space is available in both accommodation and transport.
7. Failure to Pay
Tanzania Elsewhere Safaris reserves the right to treat a booking as cancelled if final payment is not received at least 30 days before the trip start date.
8. Service Subcontracting
Tanzania Elsewhere Safaris reserves the right to cancel or subcontract any part of the program without prior client consent.

G. CANCELLATIONS
1. General Policy
Tanzania Elsewhere Safaris understands that unforeseen circumstances can occur, and we allow clients to cancel confirmed bookings at any time. However, cancellation fees will apply based on the proximity to the departure date.
Clients are strongly advised to purchase cancellation insurance, as no refunds will be issued for trips missed or cut short once started.
2. Cancellation by the Client
• All cancellations must be submitted in writing via email or our online cancellation form.
• Phone follow-ups are encouraged to avoid miscommunication.
Cancellation Fees:

29–14 days 50% of program cost
13–7 days 75% of program cost
6–0 days 100% of program cost (no refund)
3. Cancellation by the Company
• If Tanzania Elsewhere Safaris cancels your booking, you will receive a full refund of your deposit via bank transfer or cash.
• In the event of extreme or unforeseeable circumstances (e.g., natural disasters, political unrest), Tanzania Elsewhere Safaris reserves the right to cancel the trip. In such cases:
o Prior expenses already incurred (e.g., accommodation bookings, equipment reservations) will be deducted from the client’s refund.
o The company is not liable for reimbursing any non-refundable costs already paid to third-party providers on the client’s behalf.

H. CHANGE OF BOOKING BY THE CLIENT
After a booking has been confirmed, clients wishing to change to an earlier departure date may do so subject to availability and upon payment of a USD 25 transfer fee.
Please note that normal cancellation fees (as outlined in Section G.2.a) will still apply where relevant.
To postpone a program, clients must follow the standard Booking Procedures as outlined in Section F.

I. CHANGE OF BOOKING BY THE COMPANY
Clients understand and accept that itineraries are subject to change based on local conditions. Tanzania Elsewhere Safaris cannot be held liable for any claims, including consequential damages, arising from the unavailability of accommodations or other services during the tour.
The client agrees to indemnify and hold Tanzania Elsewhere Safaris harmless from any such claims.
Tanzania Elsewhere Safaris reserves the right to cancel any tour without prior notice. In such cases:
• All payments received will be refunded in full, which will constitute the entire liability of the company to the client.
• No full refund will be made if the cancellation is due to external circumstances (see Section G.2.b).

J. BAGGAGE
• Baggage is limited to 12 kg per person in a soft bag (including camera gear and carry-on items), due to vehicle space and safety considerations.
• Additional baggage may be stored or transferred to your accommodation, subject to extra charges and prior arrangement.
Tanzania Elsewhere Safaris does not accept responsibility for any loss, damage, or theft of baggage or personal effects at any point during the booking.

K. TRAVEL DOCUMENTS
It is the client’s responsibility to ensure possession of all valid travel documents, including:
• Passport
• Visas
• Vaccination certificates
• Any other documents required for entry, transit, or return
While Tanzania Elsewhere Safaris may offer guidance, it is done entirely at the company’s discretion and does not constitute a liability or guarantee.
The company accepts no responsibility for refused entry into any country due to incomplete or incorrect documentation. In such cases, no refunds or compensation will be issued.

L. INSURANCE
Clients are required to obtain comprehensive travel insurance before the booking. Coverage must include, but is not limited to:
• Trip cancellation or curtailment
• Emergency medical treatment and evacuation
• Repatriation expenses
• Loss or theft of baggage and valuables
• Natural disasters or civil unrest
Tanzania Elsewhere Safaris and its representatives shall not be held liable for any costs, damages, or losses resulting from the above eventualities.
Please note: Credit card travel insurance is often insufficient for the nature of safaris and Kilimanjaro climbs travel. Clients are responsible to confirm that their travel insurance policy meets their needs for the type of booking and activities they want to do while in Tanzania.
Further, any and all emergency services and related costs are the sole responsibility of the client and must be settled directly with the service providers.

M. INDEMNITY AND LIMITATION OF LIABILITY
Tanzania Elsewhere Safaris , its staff, agents, or affiliates shall not be liable for any loss, damage, injury, delay, or death caused by any reason, including but not limited to:
• Errors in published materials
• Illness, theft, or accidents
• Weather events, strikes, war, or government action
• Changes to itineraries or program details
• Travel delays or cancellations by third-party providers
The company reserves the right, at its sole discretion, to:
• Cancel or amend any part of the program without liability
• Refuse service to clients whose behavior is deemed unsafe, illegal, or disruptive
• Make decisions in the best interest of group safety and operational feasibility
Clients acknowledge that participation in a safari involves inherent risks, including but not limited to:
• Wild animal encounters
• Travel in remote areas
• Limited access to medical services
• Use of various modes of transport (land, air, water, etc.)
By booking a trip with Tanzania Elsewhere Safaris , the client:
• Assumes all such risks knowingly and voluntarily
• Agrees to release the company from any claims, losses, or liabilities
• Accepts that these terms are binding and enforceable even if a portion is deemed invalid by a competent authority

N. HEALTH
Clients acknowledge that they are aware of the proposed itinerary and confirm they are medically fit to participate in the tour. A medical certificate is required for travelers aged 65 years or older.
While Tanzania Elsewhere Safaris aims to provide accurate information, all services and prices are subject to change or withdrawal without prior notice due to circumstances beyond the company’s control.

O. FACTORS BEYOND THE COMPANY'S CONTROL
Clients understand that unforeseen events such as:
• Poor road conditions
• Bad weather
• Accidents
• Border closures
• Political unrest or war
• Natural disasters (e.g. earthquakes, floods)
• Government policies or bylaws
may affect or alter the planned itinerary. In such cases, Tanzania Elsewhere Safaris bears no liability for delays or disruptions.
Costs related to alternative travel, return flights, accommodation, meals, or other personal expenses arising from such disruptions are the client’s sole responsibility.
Clients are reminded that comprehensive travel insurance is mandatory for all tours.

P. AIRLINE RESPONSIBILITY
Tanzania Elsewhere Safaris is not liable for any acts, omissions, or events occurring during the period in which clients are not aboard company-arranged transport.
Airline and carrier contracts shall be binding between the client and the carrier. Any claim regarding flight delays, cancellations, or baggage issues must be made directly with the airline under their terms of service.

Q. MARKETING AND PUBLICITY
Tanzania Elsewhere Safaris reserves the right to use photographs and video footage taken during tours for marketing, advertising, and promotional purposes.
By booking a trip, the client grants consent for their image to be used and acknowledges that the company retains copyright ownership of such material.
Clients are also encouraged to leave a review or recommendation on the company’s website: https://tanzaniaelsewhere.com, or in the physical guestbook.
Clients will be asked for permission regarding the use of their name, email, phone number, and comments for marketing purposes.

R. BINDING CODE AND COMPLIANCE
Clients must respect the authority of the guide or driver, whose decisions are final for the safety and enjoyment of the group.
Clients are required to comply with the laws, customs, and currency regulations of all countries visited.

S. RISK
Participation in safaris arranged by Tanzania Elsewhere Safaris involves inherent personal risk due to the adventurous nature of travel.
By booking a tour, the client:
• Accepts full responsibility for all associated risks
• Agrees to indemnify and hold harmless Tanzania Elsewhere Safaris, its staff, and agents from any liability related to injury, death, illness, damage, or loss
• Acknowledges that they are traveling at their own risk

T. PRICE INCREASES
Tour prices are based on current national park fees and government taxes. Should these fees/taxes be increased after a booking has been confirmed, the client will be required to pay the difference in cost, even if the original booking has been invoiced or partially paid.

U. CONSENT
Payment of a deposit or any partial payment toward a reservation constitutes consent by all individuals covered by that payment to these Terms and Conditions, regardless of whether a physical signature has been provided.
No changes to these terms shall be valid unless agreed in writing and signed by an authorized representative of Tanzania Elsewhere Safaris.
